Armando Montelongo Seminars (“AMS”) makes this website (the “Site”), including all information, text, and graphics on the Site as well as the products and services offered and/or operated by AMS through the Site (collectively “Products and Services”), available for your use subject to the terms and conditions set forth in this document, as may be revised from time to time by AMS (collectively, the “Terms of Use”). BY ACCESSING OR USING THIS SITE IN ANY WAY, INCLUDING, WITHOUT LIMITATION, EVALUATING, PURCHASING THE PRODUCTS AND SERVICES DISPLAYED AND/OR OFFERED ON THIS SITE, OR BY MERELY BROWSING THIS SITE, YOU EXPRESSLY ACKNOWLEDGE THAT YOU HAVE READ AND AGREE TO BE BOUND BY THE TERMS OF USE AND AMS’ PRIVACY POLICY, WHICH IS INCORPORATED HEREIN BY REFERENCE.

This Site is intended for lawful use by persons over eighteen (18) years of age in the United States and Canada. AMS reserves the right to change the Terms of Use and other AMS guidelines and policies (including, but not limited to, the Privacy Policy and the Terms and Conditions) posted on the Site from time to time at its sole discretion, with or without notice, and the revised Terms of Use and other revised guidelines and policies shall be posted on the Site. Your continued use of the Site, or any Products and Services accessible through it, constitutes your acceptance of the revised Terms of Use, and your use of the Site will be subject to the most current version of the Terms of Use, policies, and guidelines posted on the Site at the time of such use. Therefore, you should periodically check the Terms of Use and policies on AMS’ home page to view the then current versions. If you breach any of the Terms of Use, your authorization to use this Site and any authorized use of AMS Products and Services shall automatically terminate.

Certain Products and Services available on or through this Site are available only to persons who have purchased them under agreement with AMS (the “Purchasers”).

INTELLECTUAL PROPERTY; LIMITED LICENSE TO USERS.

This Site and the Products and Services are protected by copyright, trademark, patent, and/or other intellectual property laws, and any unauthorized use of the Site, and/or Products and Services may violate such laws in addition to the Terms of Use. Except as expressly provided herein, AMS does not grant any express or implied license to the Site or the Products and Services. You agree not to copy, republish, download, transmit, modify, rent, lease, loan, sell, assign, distribute, license, sublicense, reverse engineer, or create derivative works based on, the Site and its Products and Services, except if expressly authorized herein.

TRADEMARK INFORMATION.

The trademarks, logos, and service marks (“Marks”) displayed on this Site are the property of AMS or third parties. You are not permitted to use the Marks without the prior written consent of the owner of the Mark. Armando Montelongo and Armando Montelongo Seminars are trademarks of AMS.

SUBMISSION OF INFORMATION.

Information submitted through this Site may be accessed and used by an AMS service provider. Although AMS and its service provider each take certain steps in an effort to protect the electronic transmission of credit card numbers (“Financial Information”) that you submit through the Site, AMS does not guarantee the security of any information transmitted to or from the Site. You understand and agree to assume the security risk for any information you provide using the Site.

If you submit personally identifiable information via the Site, AMS will treat it in accordance with the Privacy Policy found on this Site and our service provider will treat it in accordance with its Privacy Policy.

USER CONDUCT.

In using the Site, including all Products and Services available through it, you agree:

  • not to create a false identity;
  • not to use or attempt to use any other person’s exclusive access to the Site;
  • not to attempt to transmit any personal or financial information which you are not authorized to transmit; and
  • not to disrupt or interfere with the security of, or otherwise cause harm to, the Site, or any Products and Services, Site Materials, system resources, accounts, passwords, servers, or networks connected to or accessible through the Site or any affiliated or linked site.TERMS AND CONDITIONS

USE OF PRODUCTS AND SERVICES.

When purchasing or using Products and Services on this Site that are offered by AMS, you shall be subject to these Terms and Conditions and to the Terms of Use. In the event of a conflict between the Terms of Use and the Terms and Conditions, the Terms and Conditions shall control with respect to your rights to the Products and Services.

FULFILLMENT POLICY.

It is your obligation to access and use the Products and Services that are purchased and offered. If you wish, you may contact the phone number at the bottom of this notice to obtain instructions and assistance in doing so. AMS accepts no responsibility for your inability or lack of access or use of the Products and Services offered on the Site, but will assist you as needed. AMS also reserves the right to provide you with alternative materials and services as fulfillment of your purchase. Any alternative materials are provided for personal use and do not constitute a license to duplicate such materials.

ELECTRONIC DEVICES AND DISRUPTIVE BEHAVIOR.

Use of mobile phones, and use or possession of cameras or any recording device, is strictly prohibited at all AMS events. If a mobile phone is used by, or a camera or recording device is discovered in possession of, a student or a student causes a disturbance, he or she will be asked to leave the event and will not be entitled to a refund. Any recording or broadcasting equipment brought in, or used, other than for private non-commercial purposes and without the prior written consent of AMS may be confiscated by AMS and any recordings made destroyed.

SELLING AND ADVERTISING.

No participant may sell, offer for sale, or advertise for sale any products or services not affiliated with Armando Montelongo Seminars and its affiliates. AMS reserves the right to remove any one from the event for violation of such condition. Suitcasing and Outboarding at AMS events are strictly prohibited. Suitcasing refers to the practice of companies or persons who go to events as attendees but “work the aisles” from their suitcase (briefcase), soliciting business from other attendees and exhibitors.

Outboarding refers to non-supporting companies who set up exhibits or events at off-site locations, such as hotel hospitality suites or nearby restaurants, and encourage attendees to leave the event floor and spend time with them. AMS encourages networking between attendees for real estate investments, but soliciting for competing investment, stock, finance, or wealth-building business or soliciting for any business that interferes with or disrupts the event will not be tolerated. If Attendees or their agents are found suitcasing or outboarding at AMS events, every individual involved will be asked to leave the relevant event and will not be entitled to a refund.

NO PROFESSIONAL ADVICE OR GUARANTEE.

You acknowledge that AMS has not and will not render financial, investment, legal, accounting or other professional services or advice and has not and will not guarantee or warranty, in any respect, the benefits, monetary or otherwise, of its Products and Services. If you choose to purchase real estate or otherwise invest, it is your sole responsibility to seek independent advice from professionals of your choosing such as real estate agents, brokers, appraisers, title companies, accountants, attorneys and mortgage and stock brokers.

LIMITATION OF LIABILITY.

The price of the Products and Services purchased pursuant to this Agreement is based upon the provisions of this Agreement that limit the liability of AMS and under which you accept certain risks. In no event shall the aggregate liability of AMS to you arising under this Agreement for all damages, including without limitation any special, consequential, or indirect damages, exceed the price of the respective Products and Services.

GOVERNING LAW.

Unless prohibited by the laws of the state in which this Agreement is entered, this Agreement shall be interpreted and in all respects governed by the laws of the state of Texas.

ENTIRE AGREEMENT.

These terms and conditions pursuant to the use of this site and/or any purchase conducted hereupon comprise the entire agreement and understanding concerning the subject matter herein and supersedes and replaces any prior negotiations and agreements between you and any authorized representative of AMS, whether written or oral. This Agreement shall not be amended, modified, or altered except by written agreement signed by all the parties hereto. Each registered attendee will be held responsible under these Terms and Conditions.

REFUND POLICY.

This is an intangible educational service that cannot be canceled or revoked. Once invoice is paid, buyer agrees there are no cancellations, returns, or refunds of any sort because of the nature of services rendered.
